    HR's Role In Managing Social Media Issues

    A social media strategy has become a part of many business plans.  Despite the many positives with these technological advances, there are many risks to businesses when employees utilize such tools.  For example, employee use of social media also may create exposure to potential liability for things such as unlawful harassment, defamation, invasion of privacy, retaliation, discrimination, and misappropriating trade secrets and other confidential information.  In addition, employees may claim an ownership interest in social media accounts or the content of such accounts that are business related.  To help manage these risks, a company should implement an effective social media policy and educate its employees on the parameters of the policy.  Topics for this presentation include identifying social media, identifying ways in which social media can undermine a company’s reputation, identifying ways in which social media can expose a company to potential liability, identifying ways in which social media accounts and intellectual property may be at risk, and developing policies that help reduce the risks associated with the use of social media.

    Stephen B. Stern is a Partner with the law firm of Hyatt & Weber, P.A.  In connection with his employment practice, Stephen helps employers minimize exposure to liability by developing and implementing effective employment policies and practices.  In this regard, Stephen advises employers on strategic matters, such as trade secret protection programs, non-compete, non-solicitation and confidentiality agreements, wage and hour practices, privacy issues, independent contractor arrangements, employee handbooks, and document retention practices.  In addition, Stephen advises employers on issues that arise on a day-to-day basis, such as leave requests, employee discipline, accommodations for individuals with disabilities, and termination decisions.  He also conducts training seminars and investigations into allegations of misconduct.  When litigation has been required, Stephen has successfully represented clients in federal and state courts and before federal, state, and local administrative agencies, including the EEOC and Department of Labor.  His cases have involved claims under Title VII, ADEA, ADA, FLSA, FMLA, SOX, and similar state statutes.  In addition, Stephen has litigated numerous trade secret disputes and cases involving non-compete, non-solicitation, and confidentiality agreements, as well as related tort claims.  Stephen also has litigated matters involving consumer protection claims, bank loans, real estate disputes, commercial contracts, shareholder and partnership disputes, unfair competition, fraud, fiduciary duties, mass torts, products liability claims, professional discipline, false imprisonment, and civil rights violations.
