TOPIC: Employment Eligibility Verification

Summary of the presentation:
In recent years, federal and even some state governments have promulgated several regulations aimed at holding employers responsible for employing unauthorized workers, most notable is the requirement to use E-Verify, an electronic system that confirms an employee’s name with his/her Social Security or immigration information. The Department of Homeland Security also has intensified the investigation of employers and audits of the Form I-9.
At the same time, the Justice Department’s Civil Rights Division is becoming increasingly aggressive in charging employers with discrimination when employers become too cautious in the verification and “I-9” process and scrutinizes certain workers beyond what the law requires because of perceived immigration status.
The tension between verification and antidiscrimination requirements have put employers in a “Catch-22.” This presentation will help employers comply with both requirements and to avoid common pitfalls.
