    On MondayHB 001, Healthy Working Families Act received a favorable report with amendments in the House Economic Matters Committee.  IMPORTANT: It is expected to receive further consideration with a 2nd reading today, February 28th and a 3rd reading either Wednesday or Thursday.  None of the amendments by MDSHRM are being considered.   These are:

    • no increase to the # of EE threshold from 15 to 50 employees
    • no decrease in the # of paid leave days from 7 to 5
    • no increase in the number of hours an eligible employee must regularly work from 8 to 30
    • Possibly room for negotiation on the sanctions.

    Other Bills: Another hot topic is HB 665/SB 607, “Exemptions From Overtime Pay - Administrative, Executive, or Professional Capacity,” In short, this bill effectively implements the FLSA changes the USDOL attempted to implement but did not go into effect December 1st.  If enacted, MD would be just one of 15 states that would have its own white collar/EAP regulations, requiring all MD employers to once again conduct a dual analysis (one under federal; one under state) before an employee can be properly classified as exempt. The House bill was heard last week; the Senate bill will be heard this Thursday
